Terms of Service
Last updated: October 1, 2026
Welcome to Sweep. These Terms of Service (“Terms”) are an agreement between you and Sweep Outdoors Inc., a Delaware corporation (“Sweep,” “we,” “us,” or “our”). These Terms govern your access to and use of the Sweep mobile applications, the website at sweep-app.com, and related products and services (collectively, the “Services”).
By creating an account or accessing or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree to these Terms, do not use the Services.
1. Eligibility and Accounts
You must be at least 13 years old to use the Services. If you are under 18 or under the age of majority where you live, you may use the Services only with the consent of a parent or legal guardian.
When creating an account, you agree to provide accurate information and keep it current.
You are responsible for:
- Maintaining the confidentiality and security of your account credentials;
- All activity that occurs under your account; and
- Promptly notifying Sweep through our website if you believe your account has been accessed or used without authorization.
You may not share your account or use another person’s account without permission.
2. The Services
Sweep is an outdoor exploration and navigation platform that may provide features including:
- Park and trail maps;
- Official park maps displayed with location information;
- GPS-based location and navigation;
- Route and activity tracking;
- Activity history;
- Offline map access;
- User-submitted maps and other content;
- Social and community features; and
- Tools for groups, hike organizers, or other outdoor organizations.
Some features depend on your device, operating system, internet or mobile connection, and permissions you grant through your device.
We may add, change, suspend, or discontinue features or portions of the Services at any time.
The Services may incorporate, display, or interact with information, maps, imagery, services, or technology provided by third parties. Third-party services may be subject to separate terms and privacy policies. Sweep does not control and is not responsible for third-party services.
3. Your Content
You may submit or create content through the Services, including photos, profile information, comments, maps, map files, recorded hikes and routes, waypoints, reports, hike details, and other materials (“User Content”).
You retain ownership of your User Content.
By submitting User Content, you grant Sweep a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, adapt, process, display, publish, and distribute that User Content as reasonably necessary to operate, provide, maintain, improve, develop, and promote the Services.
Except for contributed maps and map-related materials as described in Section 4, this license ends when you delete the applicable User Content or your account, except to the extent that:
- The content has been shared with others or made public and others have retained or relied upon it;
- Copies remain temporarily in backup or archival systems; or
- We are required or permitted to retain the content for legal, security, fraud-prevention, or other legitimate purposes.
You represent and warrant that:
- You own your User Content or have all rights and permissions necessary to submit it and grant Sweep the rights described in these Terms;
- Your User Content and Sweep’s permitted use of it do not infringe or violate another person’s intellectual property, privacy, publicity, or other rights; and
- Your User Content complies with applicable law and these Terms.
We may restrict, remove, or disable access to User Content when we reasonably believe it violates these Terms, applicable law, or the rights of others.
4. Map Contributions
The Services allow users to submit park maps and other map-related materials, including photographs of maps, map files, brochures, PDFs, and other source materials (“Map Contributions”).
Sweep may process Map Contributions, including by cropping, correcting, converting, aligning, georeferencing, enhancing, or otherwise preparing them for use within the Services. Some processing may be performed using automated technologies.
You may only submit Map Contributions that you own or have the legal right to provide and authorize Sweep to use.
Some materials created by U.S. federal government agencies may be in the public domain. Maps or other materials created by state or local governments, private landowners, organizations, publishers, or other parties may be protected by copyright or other intellectual property rights. You are responsible for determining whether you have the right to submit a particular Map Contribution.
By submitting a Map Contribution, you grant Sweep a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, adapt, process, display, publish, distribute, and otherwise use the Map Contribution in connection with the Services.
This license continues even if you later delete the Map Contribution or your Sweep account. This allows maps that have been incorporated into Sweep and made available to other users to remain available after the contributing user leaves the Services.
Sweep may identify or credit the source of a Map Contribution where appropriate but is not obligated to credit the contributing user unless otherwise required by law or an applicable license.
Sweep may decline, edit, replace, restrict, or remove any Map Contribution at any time, including in response to a copyright complaint or other rights claim.
5. Location and Activity Data
When you use location, navigation, or recording features, Sweep may collect location and activity information such as routes, distance, duration, and location data as described in our Privacy Policy.
Location access is optional and controlled through your device settings.
You understand that:
- Location and activity information may be stored and associated with your account;
- GPS and other location technologies may be inaccurate or unavailable;
- Recorded activities may be stored as part of your activity history; and
- Information is shared publicly only when the applicable feature indicates that you are choosing to share it.
For additional information about how Sweep handles personal information, see our Privacy Policy.
6. Feedback
If you provide Sweep with ideas, suggestions, recommendations, or other feedback regarding the Services, you grant us the right to use that feedback without restriction or compensation to you.
7. Content Moderation and Reporting
Sweep does not undertake an obligation to review all User Content before it appears on the Services or to continuously monitor the Services.
We may review, restrict, remove, or disable content, or suspend or terminate accounts, when we reasonably believe content or conduct violates these Terms or applicable law, infringes another person’s rights, or creates risk for Sweep, our users, or others.
Users may report inappropriate content or other concerns through reporting functionality made available within the Services or by contacting Sweep through our website.
Copyright infringement claims are handled as described in Section 8.
8. Copyright and DMCA
Sweep respects the intellectual property rights of others and expects users of the Services to do the same.
In accordance with the Digital Millennium Copyright Act (“DMCA”), Sweep responds to valid notices of claimed copyright infringement involving content available through the Services.
If you believe content available through Sweep infringes your copyright, please review and follow our DMCA Copyright Policy, available at:
The DMCA Copyright Policy explains how to submit a copyright infringement notice or counter-notification and provides the contact information for Sweep’s designated Copyright Agent.
Repeat Infringers
Sweep has adopted and reasonably implements a policy providing for the termination, in appropriate circumstances, of users who are repeat copyright infringers.
Sweep may also remove or disable access to allegedly infringing material and may restrict, suspend, or terminate accounts that infringe or are reasonably believed to infringe the intellectual property rights of others.
9. License to Use Sweep
Subject to your compliance with these Terms, Sweep grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services for their intended purposes.
Except as expressly permitted by Sweep, you may not sell, license, rent, distribute, reproduce, modify, publicly display, publicly perform, publish, adapt, create derivative works from, or otherwise commercially exploit the Services or Sweep content.
We reserve all rights not expressly granted to you.
10. Prohibited Conduct
You agree not to:
- Violate any applicable law or another person’s rights;
- Upload or share content that infringes intellectual property or other rights;
- Submit content that is unlawful, fraudulent, defamatory, threatening, harassing, hateful, obscene, or otherwise harmful;
- Impersonate another person or misrepresent your affiliation with a person or organization;
- Disclose another person’s private information without authorization;
- Upload malicious software, viruses, or harmful code;
- Attempt to gain unauthorized access to the Services, accounts, systems, or networks;
- Circumvent security measures, access controls, or technical restrictions;
- Interfere with or disrupt the Services;
- Scrape, crawl, harvest, or systematically extract maps, park information, user information, or other content except as expressly authorized by Sweep;
- Build or populate a competing database, mapping product, or service using content obtained from the Services;
- Use content obtained from the Services to train or improve artificial intelligence or machine-learning models without Sweep’s written permission;
- Reverse engineer, decompile, or disassemble the Services except to the extent applicable law expressly permits it; or
- Resell, sublicense, frame, mirror, or commercially exploit the Services without our written permission.
11. Sweep Intellectual Property and Third-Party Content
The Services and their software, technology, interfaces, designs, logos, branding, compilations, processing, and other content provided by Sweep are owned by or licensed to Sweep and are protected by intellectual property and other laws.
“Sweep,” Sweep’s logos, and other Sweep marks are trademarks or other protected identifiers of Sweep. You may not use them without our permission.
Certain maps, imagery, geographic information, or other materials available through the Services may be owned by government entities, park agencies, mapping providers, licensors, users, or other third parties.
Sweep’s display or inclusion of third-party materials does not transfer ownership of those materials to Sweep or to you. Third-party materials may be subject to additional license terms, attribution requirements, or restrictions imposed by their respective owners or licensors.
12. Outdoor Safety and Assumption of Risk
Hiking and other outdoor activities involve inherent and potentially serious risks, including falls, injury, illness, getting lost, extreme weather, water hazards, wildlife encounters, changing trail conditions, natural hazards, encounters with other people, and death.
You are solely responsible for evaluating your abilities, surroundings, route, equipment, weather, trail conditions, and other circumstances relevant to your activities.
Sweep is not an emergency service.
Before engaging in outdoor activities, you should check current conditions, closures, restrictions, permits, and safety information with the appropriate park, land manager, or other authoritative source.
You are responsible for complying with applicable laws, park rules, closures, permits, private-property restrictions, and other requirements.
To the fullest extent permitted by law, you voluntarily assume the risks associated with outdoor activities and your use of the Services.
13. Maps, GPS, and Information Accuracy
Maps, GPS locations, routes, trail information, geographic information, and other content available through Sweep are provided for general informational and navigational purposes.
They may be incomplete, inaccurate, outdated, misaligned, or unavailable.
Among other limitations:
- A map’s geographic alignment may be approximate;
- GPS location can be inaccurate, drift, or fail;
- Trails, roads, access points, boundaries, closures, and conditions may change;
- Offline maps may not reflect changes made after they were downloaded; and
- Devices, batteries, sensors, internet connections, and location services may fail.
You should not rely on Sweep as your sole means of navigation or safety information, particularly where an error could result in injury, getting lost, trespassing, or other harm.
Actual conditions, posted signs, instructions from park personnel or land managers, and official closure or safety notices take priority over information displayed through Sweep.
14. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT AVAILABLE THROUGH THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
SWEEP DISCLAIMS ALL WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND RELIABILITY.
Sweep does not warrant that the Services will be uninterrupted, secure, available, or error-free or that maps, GPS locations, routes, trail information, or other content will be accurate, complete, safe, or current.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SWEEP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, SWEEP’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
(A) THE AMOUNT YOU PAID TO SWEEP DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
(B) $100.
These limitations apply regardless of the legal theory on which a claim is based and to the fullest extent permitted by applicable law.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
16. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Sweep and its officers, directors, employees, agents, and affiliates from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
- Your User Content;
- Your use or misuse of the Services;
- Your violation of these Terms;
- Your violation of applicable law; or
- Your violation of another person’s rights.
Sweep may assume control of the defense of a matter subject to indemnification, and you agree to reasonably cooperate with us.
17. Termination and Account Deletion
You may stop using the Services at any time.
You may request deletion of your account using the account deletion option available within the Sweep app, which will direct you to our website to complete the account deletion request.
Upon account deletion, we may delete or de-identify information associated with your account in accordance with our Privacy Policy, subject to information we are permitted or required to retain.
Deleting your account does not terminate the license applicable to Map Contributions under Section 4. Map Contributions that have been incorporated into the Services may therefore remain available after your account is deleted.
We may suspend, restrict, or terminate your access to the Services if:
- You violate these Terms;
- Your use creates legal, security, or safety risks;
- We are required to do so by law; or
- We discontinue the applicable Services.
Upon termination, your right to use the Services ends.
Provisions that by their nature should survive termination will survive, including provisions concerning intellectual property, Map Contributions, disclaimers, limitations of liability, indemnification, dispute resolution, and other provisions intended to continue after termination.
18. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO HAVE CERTAIN DISPUTES DECIDED BY A COURT OR JURY.
Informal Resolution
Before initiating arbitration or other formal proceedings, you and Sweep agree to attempt in good faith to resolve the dispute informally.
You may initiate this process by submitting a written description of the dispute and the relief you are requesting through the contact form available at sweep-app.com.
The parties will attempt in good faith to resolve the dispute for at least 60 days after receipt of the notice before commencing arbitration, unless applicable law permits otherwise.
Individual Arbitration
Except for disputes that qualify for small claims court and requests for injunctive or equitable relief concerning intellectual property or unauthorized use of the Services, disputes arising out of or relating to these Terms or the Services will be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision.
No Class Actions; Jury Trial Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND SWEEP AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.
YOU AND SWEEP WAIVE THE RIGHT TO A TRIAL BY JURY FOR DISPUTES SUBJECT TO ARBITRATION.
Arbitration Opt-Out
You may opt out of this arbitration agreement within 30 days after you first accept these Terms.
To opt out, submit a written request through the contact form at sweep-app.com that clearly states:
- Your name;
- The email address associated with your Sweep account; and
- That you wish to opt out of the arbitration provision in the Sweep Terms of Service.
Opting out of arbitration will not affect any other provision of these Terms.
19. Governing Law
These Terms are governed by the laws of the State of Delaware and applicable United States federal law, without regard to conflict-of-law principles.
To the extent a dispute is not subject to arbitration, the parties consent to the jurisdiction of the state and federal courts with applicable jurisdiction, subject to any rights you may have under applicable consumer-protection law.
20. App Store Terms
If you obtain the Sweep application through Apple’s App Store, Google Play, or another application marketplace, you acknowledge that these Terms are between you and Sweep and not the applicable app marketplace.
Sweep, and not the app marketplace, is responsible for the Services and their content, maintenance, support, and claims relating to the Services except as otherwise required by the marketplace’s applicable terms.
Your use of the application must also comply with the applicable marketplace’s terms and usage rules.
For applications obtained through Apple’s App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, have the right to enforce applicable provisions against you.
21. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we will provide notice through the Services, our website, or other reasonable means before the changes become effective when required by applicable law.
The “Last updated” date indicates when these Terms were most recently revised.
Your continued use of the Services after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by law. If you do not agree to the revised Terms, you should stop using the Services.
22. General Terms
Entire Agreement. These Terms and our Privacy Policy constitute the agreement between you and Sweep concerning the Services and supersede prior agreements concerning the Services.
Severability. If a provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in effect.
No Waiver. Sweep’s failure to enforce a provision of these Terms does not waive our right to do so later.
Assignment. You may not assign or transfer these Terms without our written consent. Sweep may assign these Terms in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or otherwise as permitted by law.
Force Majeure. Sweep will not be liable for delay or failure caused by circumstances beyond our reasonable control.
Electronic Communications. You agree that notices and other communications may be provided electronically where permitted by law.
No Agency. Nothing in these Terms creates a partnership, joint venture, employment, fiduciary, or agency relationship between you and Sweep.
Headings. Section headings are for convenience only and do not affect interpretation of these Terms.
